Barclays sends letter, which raises more questions

A letter just arrived as a quick read reveals it's the usual, it's your fault nothing to do with us. We Barclays Bank never make any mistakes.... So lets just go through bits of this


From Letter

dear mr..... blah blah, i have reviewed all the file and blah, blah it's all your fauly.... "it was a long time ago and it's your fault, cos you should have told us earilier." Anyway if you don't like my findings. Go contact the ombudsman and "good luck with that." please also "find attached more of the information you've requested several times already." "As you didn't send us the information about the field agent attempting to gain illegal access to your property, I'm also saying that did'nt happen!" "Your claim that you where coerced by our bank staff in Weybridge, is simply impossible as it would break the bank code and would be entirely the wrong way to go about this matter." "So that didn't happen either....!"


My question in our phonecall on Bank Holiday Monday at 08.30 which is before the letter was sent to print. "did you look at the business account and why it was closed, which caused the debt, you tried to crystalise by means of the fraudlant loan, your bank staff told me I had no choice other than signing it and agreeing to it's terms" This was my question from my original complaint plus it also confirmed that "the ombudsman found in favour of us being harrassed and threated very badly by Barclays." The Ombudsman went on in their recommendation "both entrenched parties should negotiate a way out of the problem!"


So the opening gambit of a phone call on the monday, waking me up and then getting my day off to an unlikely start. Should have resulted in the following action, the Originator of the correspondence should have listened to the additional information. Returned to the drawing board, contacted the relavant departments to get their input. "As the Letter being sent out to me the same day, was no longer accurate or true!" The Originator has ineffect placed himself in an unusual position of claiming to be have read it all, but that simply can't be true! It is also impossible for them to remain fair, objective and impartial when the facts suggest otherwise. When combined with the new materail facts to support my claim for poor service, are presented they would known had they read the file, we can't go to the ombudsman. The issue of not supplying the evidence of the break in attempt, is a problem as barclays forms for complaints do not accept weblinks to my video server, so that's my fault? As Barclays don't work in the 21st century, I get called a liar and have my rights of complaint removed and ignored! Barclays as an organisation claims they do not use email as a means of correspondence... Well thats an out and out lie by Barclays, as they clearly do as in the appers it states their CEO had sent 1200 emails to a certain Jeffery Epstein and that raises the question how many of those could have been images or video files or contained links to external webpages...? Makes you think...!


My second call on Tuesday from Barclays Bank (unconfirmed department) to discuss my complaints went a little better, I was given her name and surname, on request. We talked freely and I doubt there was any agression in her tone, I was asked what happened, what I'd like to do and how we could progress this matter. All of which sounded reasosnable and in keeping with a negotiation process. I asked if I could send her an email or if she could send something to me as in my words. "I doubt anyone would believe me otherwise" She was unable to give me her "in company email" but I was sent a confirmation email from her department. So that shows there is a process and that was clearly ignored by the repvvious caller.


As for the treasure trove of new bits sent over, what can I say some are finally original (all be it copies) of forms I was told didn't exist. Or I was according to Barclays staff not allowed to see them or request them using the FOI access granted in law to anyone wishing to see information that relates to them, and could include any information that isn't deemed restricted and business sensitive. So by not sending them earlier Barclays bank appears to by their own admission breached both my rights to GDPR and the ICO guidelines and probably several other laws. I did request all of these, at the stage of my first complaint 10 years ago. Other items are the original (all be it copies) of prints which I was sent in redacted miniture versions 5 years. making them impossible to read or do anything with. According to the some legal advice than came via a family friends solicitor an ex fraud office investigator he just said well you know why they're more than likely doing this cos there's facts they don't want you to see!" However this did prove the stuff mysterious stuff that, didn't exist! Does exist and I now need to requested the supporting paperwork as per my original and ignored requests 10 years ago. As it suggested complete copies must be in the system. They just needed to be found, or looked for properly.


Some items I've never seen before. Their date stamps suggest I was in the early phase of my recovery from the near fatal accident. As for it all being very old and so no longer relavant to my claim of poor service, I did make Barclays aware as soon as I found out, the as yet not present information would show where to initial error occured and who carries the blame. Which is what we're looking to establish, we all know something happened but without a show and tell negotiation it's just remains a standoff between entrenched parties.


Conclusions is the bank looking to annoy me or harrass me? Scare my wife as barclays letters are a horrific traumatic thing, for her to see and deal with.


Which you maybe able to imagine., we've lived this nightmare for long enough. Will the bank give me the information? Information I have a right to see and which could finally bring this matter to a close for both sides...? Or are they just playing for time while they further damage my credit rating, sit on an imaginary debt they themselves created. Holding us to Ransom in our own home. Which I pointed out at the time was a self fullfilling prohecy... when I very first was told by a chap from Barclays when we discussed negoitiations. That it wasn't for him to negotiate with us, it was his job/duty to do what's best for the shareholders, here we are 10+ years later.... So I guess we get a google searchout who they all are....! and then I'll wriote a few letters to see what that brings about.


As for evidence I've not sent to them, well I have witness statements, video and audio files. All I need is a process that is agreeable to both parties. I can then make them available to Barclays and we can finally negotiate. which is what I would like to do. The omdubsman recommended and which is being blocked only by the largest obstacle in this which is Barclays Bank.


All of the above is subject to the term of "fair comment", based on poor service expirienced from barclays bank. it's staff and field agents. for 10+ years....
