Yup it's Friday and still no answers, the email I sent to the CEO will be attached at the bottom in a different colour... I was interested in spotting during last nights news some poor chap who coinde the phrase "Mortgage Prisoner" #MortgagePrisoner I thought the better description was "Mortgage Hostage" #MortgageHostage but the sentiment is much the same....
You find yourself in a manufacturered moment in time, you've been in a contract and the other party of the contract. Throws you under a bus.... effectively ending or breaking the agreement, so who's to blame..?
The Banks would have us beleive they are the victim here...! Just let that sink in, the idea that you've kept your end of the bargain and given them all the money.... and now they can at a time of their choice close all your accounts. Causing the default, causing the disruptions and then claim they are the victim... instead of the agent provocateur.... as they rightly are... it's a simple abuse of position and power.
So here we are I and Nigel Farage have something in common, I never once thought I'd say or even write this down.... More importantly sofar the dozen or so people that have contacted me saying they've also been treated in a very calculated manner by their banks all of whom have claimed there's nobody to represent them...
below is the letter sent to the CEO 13/07/2023 followed by a subject access request just about the closure of my account
Mr. Venkatakrishnan,
I was interested in watching your short interview on the BBC a day or so ago.
I again have to bring to your attention the lack of movement on my complaint, we have tried over the last 10+ years to make some progress and every time we're frustrated by other members of the Barclays staff. I have been consistent in asking the same questions, and the answers we get only raise more questions.
Even after the Ombudsman found in my favour and recommended negotiations to Barclays and myself. I'm told the senior leadership team at Barclays refuse to negotiate. I have since contacted the FCA financial conduct authority who agree with me that this is not how customers and complaints are to be handled. I therefore have to bring this back to your attention; this matter is entirely of Barclays own making. I appreciate you were not the CEO when this all started however, I urge you to be the person that brings this matter to a successful conclusion for all parties.
to bring the facts back into clear focus
Barclays broke its contract with us, when for no reason it closed all my accounts thus making it impossible to pay any bills including the mortgage.
Barclays retained my money and for no explainable reason refuses to return it
Barclays through creating a default on the mortgage levied in the region of 100K debt onto my accounts that didn't exist anymore
Barclays tried to repossess my home and trespassed on my personal injury claim, which was not settled as expected, allowing the people that nearly killed me to escape, instead I was made liable for the entire legal costs.
Which I could not pay as Barclays had closed my accounts damaged my credit rating and made it impossible to open another account.
When I pointed this out to Barclays, Barclays refused to discuss this with me
Barclays tried to hide the material facts and continues to do so
Barclays tried to coerce me into allowing Barclays to crystalise the ebt it had created from thing air into a personal loan. While in the full knowledge I would never be able to pay it, as I had no access to banking or any way to move money to this loan account. Which sounds very much like a very poor lending decision an act of desperation or simple attempted fraud on Barclays behalf
When I pointed out this was at best a mistake at worst fraud, Barclays chose to ignore me.
When I pointed out how Barclays had behaved towards us, the Ombudsman found in our favour and awarded us a small amount of compensation.
Barclays claimed the Ombudsman had found in their favour, I had to dispute this as it clearly a mistake on Barclays behalf.
I pointed out the Ombudsman recommended negotiations, and made the following offer
We stop the clock at the point the mistake was made, whatever money was paid by me against the mistaken mortgage however it was arrived at. From that point to this month for example is Tally up and taken off the amount when the clock stopped. Whatever amount remains is the new mortgage and I take that to a new lender, I'm mor than certain Barclays no longer want me as a client. I can confirm I want nothing to do with Barclays, I have been trying to resolve this for nearly 14 years, What little time I have left will better spent trying to recover from the damage done to me by Barclays and trying to manage my worsening medical condition. Barclays is also responsible for the mental breakdown caused to my Wife and my daughters' case of sever anxiety which we have to live with. I am being entirely reasonable in how I have approached the negotiations, sadly Barclays has chosen for whatever reason to act how it has acted. Which now included claiming to have sent a recording I request, which has arrived, but we've not been supplied with the passcode to access it. To boot I'm told we've been sent everything I have requested electronically so it can be viewed on a large screen and is key word searchable. This email with everything has been sent to the inbox of the account you closed so I can't open it. We have reached a moment where Barclays has moved from simply ignoring to providing evidence it claims shows nothing bad has ever happened in a format that is not readable, viewable or verifiable. We've reached a new level of taking this argument to a hypothetical level. Please see my example of Schrödinger's Cat aka Barclays Evidence As you may be aware Schrödinger's Cat is a thought experiment devised by the Austrian physicist Erwin Schrödinger, which he designed to illustrate a paradox of quantum superposition wherein a hypothetical cat may be considered both alive and dead simultaneously because its fate is linked to a random event that may (or may not) occur Transpose this to our problem, and what do you have. Barclays claims nothing has happened but places it evidence in such a format and location that is it beyond reach... so it's not evidence that supports Barclays claim. On the balance of probability, I actually suggests that after 10+ years of asking I am more than likely right how we've been treated So how can we solve our substantial long term frustrated contract dispute..? My offer is the most logical and simplest way out of the mess. Which Barclays has caused, we reverse out and leave each other alone. I therefore again request you review the above, make available the information I have requested, and we discuss as per the ombudsman recommendation with the view to resolve the dispute that exists. Or we carry on, you don't provide the evidence you claim you have and which I again would like as a subject access request made available to me a disabled person in the formats I have suggested. failure to provide with would find Barclays outside the disability discrimination act and I will raise another complaint how we've been treated. I will also refer the Ombudsman to the letter where Barclays elects themselves to being above the recommendation suggest by the ombudsman and will ask that the Ombudsman reviews all subsequent new and update complaints again. I have to point out that just referring to previous letters that also fail to answer my question isn't really acceptable anymore in light of the FCA email on how complaints should be handled. I await your reply Yours respectfully
